These Terms and Conditions govern your use of the RaceLabs website and photo galleries operated by RaceLabs (“we”, “us”), an independent self-employed provider. By accessing a gallery or searching for your photos, you accept these Terms. Please also read our Privacy Policy.

1. The service

RaceLabs provides photo-sorting and gallery technology that lets participants in an event find the photographs in which they appear. For each event, the photographs are provided by the event's photographers and the service is offered on behalf of the event organiser.

2. Ownership and intellectual property

All photographs, video and other content displayed are protected by copyright and remain the property of their respective photographers or rights holders. The RaceLabs name, logo and website are our property. Nothing in these Terms transfers any ownership to you.

3. Permitted use

• You may search for, view and download the photographs in which you appear, for your own personal, non-commercial use.
• You must not attempt to access another person's photographs, circumvent the identity-verification step, or use any automated means to scrape or bulk-download content.
• You must not resell, sublicense, commercially exploit or publicly redistribute the photographs without the rights holder's written permission.

4. Accessing your photos

Access to your personal gallery requires your bib number and date of birth, plus your consent to processing as described in the Privacy Policy. You are responsible for the accuracy of the information you enter and for keeping any access link private.

5. Purchases, refunds and replacements

[The current service is provided free of charge. When paid downloads or products become available, this section will set out pricing, the purchase process, the EU consumer right of withdrawal (14 days) together with the standard waiver of that right once a digital file is downloaded with the buyer's consent, and our refund and replacement policy, including the rule that refunds are not offered once a digital file has been downloaded, except where the file is defective and the issue is reported within [N] days with supporting evidence.]

6. Disclaimers

The service is provided “as is” and “as available”, without warranties of any kind. We do not guarantee that every photograph of a participant will be found, that the service will be uninterrupted, or that results will be error-free.

7. Limitation of liability

To the extent permitted by law, RaceLabs is not liable for indirect or consequential damages arising from the use of, or inability to use, the service. Nothing in these Terms limits liability that cannot be limited under applicable law.

8. Changes

We may update these Terms. The current version is always available at this page, with the date of the latest update shown above.

9. Governing law

These Terms are governed by the laws of Spain, and any dispute will be subject to the competent courts of Barcelona, without prejudice to any mandatory consumer-protection rights.
